Taliban were soldiers of the Afghani government then in power, the Taliban. Thus, they are POWs (uniforms, insignia, official government authorized commanders.. etc).

Al-Qaida members were primarily non-Afghan (arabs, chechens..etc) who are "unlawful combatants", but who found refuge in Taliban territory. From my understanding, almost all Taliban soldiers have been returned to either Afghanistan or Pakistan. Al-Qaida is who I'm talking about.

And so far as I'm concerned, the US was engaging in war against a state (the Taliban) which was controlled by and hosted a terrorist organization, Al-Qaida... Thus, THEY declared war against us (but just didn't announce it)..

But either way.. Taliban prisoners are POWs. Al-Qaida are unlawful combatants. And for those who might have been both, the latter has most likely been applied to them.
