I was talking about the people accused and convicted in jail and fighting for their lives. If they are truly guilty then they were not deterred. Their fighting for their life is not an indication that they were deterred from the murder they are alledged to have committed and that they thus are in fact innocent. All it means is that they are fighting for their life. We know that murderers were not deterred.

The question of whether non-murderers were or are deterred by fear of consequences is another question, and one that has been answered by innumerable studies over decades of research.
