Do you mean that a locality may pass a criminal law prohibiting the action and be constitutional?

It can't be "against the law" if there is no specific law concerning it can there?

I understand that regardless of the above, people who are injured by negligent behavior, such as yelling fire... may file a tort to be made whole. But I'm wondering about the criminal aspect.
