I doubt well run businesses would be hurt.
Marginal ones would be forced out.


When well-run businesses compete against businesses that seek bankruptcy protection, it hurts the well-run businesses in two ways that come to mind immediately:

1. The company receiving bankruptcy protection may be able to continue running its business without need to satisfy its debts, enabling it to operate at an artificially (government-subsidized) low cost that hurts the well-run company's ability to compete.

2. While some companies going BK are liquidated, the well-run company STILL is competing with companies that can operate at artificially low costs knowing that liquidation is an option at the end.

There is definitely a need for bankruptcy laws and protection, but well-run businesses indeed can and do suffer in the process.

You looked at my arguments bass ackwards....or I presented it so.

When I say the bankruptcies punish those that have run their businesses well. What I am getting at, is that those that were irresponsible or incompetent get relief in paying monies owed to well run business. Therefore, many well run businesses get the shaft due to no fault of their own.
You may argue that credit should never have been extended to the business that went belly up....well you need a darn good rear view mirror for that, sometimes.
