Yes, had I decreed that to be law back in '98, he would have had to send someone....preferrably his deadbeat brother.

2 - Its a free country. I have no power or right to send someone else to fight. I could sign up my self but it would be pointless, they don't need more people and in 6 months I will be to old to sign up (I think. Its different in different services and may have changed since my time in basic training)
