The fact that neither of us are sure suggests Mr. Pickering is not a good candidate to be a judge. Not just in Mr. Pickering's case but more generally I don't agree with that idea. The possibility that someone may have done something for a negative reason (such as racism) is not the same as the established fact that someone has done something for such a reason. Also the thing in question in this case is not itself negative. Unless you have strong reason to believe someone is racist he should not be accused of racism or treated as if he is a racist. Tim
