The issue is what happens when you get down to deciding who is going to get the last open slot in the public university. Under the 10% rule, if you have someone in a more competitive school, who scored higher on the SAT and other objective criteria, he is still going to lose out to the kid who is guaranteed a slot because he finished in the top ten percent of his class. At the end of the day, I dont think that is any more merit based than the Michigan approach. The approach of saying that the top ten percent of every school in the state gets in, regardless of their other qualifications, may simply prove to be a politically-correct proxy for facially race-based affirmative action.
