The latter part of that statement is an opinion, stated as if fact ("regardless of penalty").

The issue is not one of "invalidation," and certainly not where the justice system as a whole is considered. Rather, it has to do with ones' personal opinion: whether mistakes in the administration of justice - specifically and exclusively where executions are indicated - are or are not too high a cost to bear. Especially where a yet-unproven, and perhaps unprovable, "deterrence" effect is cited among its' justifications.
