I will ignore the fact that you are parsing for effect again and just respond to your comment. Which makes it a non-discussion but let me know how the points are lining up.

HUH??

I responded: "It certainly is, whether profound or not, the basis for determining whether the
actions are legal or illegal.


My point: The "fact" that you are making a decision to act is a basis for determining the legality or illegality of your actions.

Example:

Your neighbor's prize bull wonders onto the road in the middle of the night. You accidently hit it and kill it on your drive home. Assuming that everyone agrees it was an accident, and that you made no conscious effort to kill the bull will impact the level of criminal charges against you.

vs.

Your neighbors does your wife so you declare "I'm killin' your cow bub." You get in your car and head straight for the cow and smash into it. It dies.

In both examples you kill the bull by ramming it with your car. In the second example you have made a decision to kill it. The fact that you acted on the decision to kill the bull and that it effects your membership in humanity is the basis for the legal question.

Whatever else you meant by "a determining factor" is most likely irrelevent to the current discussion outside of this.
