I've been thinking about EP as well. I don't think today is shopping day, however. As of the close yesterday, you have the beginning of a downward retrace on the daily chart, volume is light. For those who believe in support areas, you can find some pretty good support in the 7.50~8.00 range. For those who see so much value in the fundamental story (and can safely discount the uncertainty) an early purchase (tomorrow) will ensure at least a position, whereas a patient investor/punter may not get filled.

Another way to view that chart, though, is a 5 week cup formed in December, and now we get the pullback to form the handle; if this develops, today might mark then end of the pullback. Standard TA says buy on the breakout, which would be a strong volume rise above 10.

All of this is subject to change and revision, of course, depending on how price and volume interact.

Jim, I think it's a foregone conclusion that EP was a big part of scheming to rip off California - in both gas pipeline capacity and electric trading.

Although I believe California is to blame for the self-inflicted problems, that doesn't appear to be how today's legal system works.

That is probably going to become a non-factor soon enough when they reach a settlement - which I don't expect to be a company buster. They've also got the liability out there for burning up that family when their pipeline ruptured, the initial judgement could be astronomical on that one - but with appeals, etc. the end results will probably be manageable and payable a few years down the road.

What else is there? Pension fund? Oscar Wyatt wanting his quart of blood? Whistleblowers?

While not for the meek or risk averse, I don't see EP at $9 as a bad deal.
