But the law professors I suppose don't believe Saddam can be prosecuted for war crimes for gassing the Kurds ?

INC DELEGATION VISITS UNITED NATIONS
LONDON (7 December 2002): A delegation of the Iraqi
National Congress, headed by INC Leadership Council
member Sheikh Mohammed Mohammed Ali, visited the
United Nations in New York. The INC delegation held
consultations with several UN missions including
Security Council members Norway, Mexico, and Bulgaria.
The delegation also met representatives of three of
Iraq’s neighbours: Kuwait, Turkey and Iran.

The INC delegation discussed issues of mutual concern
including the continued mass violations of human
rights in Iraq, the Iraqi regime’s implementation of
the oil-for-food programme, and the Saddam Hussein
regime’s continued violation of UNSC resolutions.

The delegation also updated the UN members on
developments in the Iraqi opposition and the struggle
to remove the Iraqi dictatorship and establish
democracy in Iraq. The delegation assured the UN
members, especially Iraq’s neighbours, that the Iraqi
opposition is united around the principle of Iraq’s
territorial integrity, sovereignty and independence.
The INC delegation stressed that a future democratic
Iraq would renounce weapons of mass destruction and
would not pose a threat to its neighbours.
