Yes, if he has done similar acts like this before but not been caught or if he has a rap sheet of any kind. If not, then I say the sentence is too long.

This is where Pickering had a problem. The 17-year old DID have a rap sheet and a history of racial animus (as well as the charge for firing the weapon). Swan, however, had no history of racial animus and no prior arrests. So this was Pickering's complaint -- Swan's sentence was too long given his history.

Yes, but once again, we don't know all the facts of this case nor the background of Swan.

Actually, I disagree -- I think we DO know all the PERTINENT facts of the case, and we DO know the important points of Swan's background. York's article went into some detail on this subject.
