He made what is considered an ex parte contact while the trial was ongoing.

The recipient of the communcation has clearly stated he did not interpret the call as inappropriate. I can't count on both hands the instances in which I've seen judges have insignificant discussions with one side or the other that would not have been labeled as ex parte. It happens as a matter of getting things dealt with.

For an ex parte communication to be a problem, there really has to be something substantive going on -- not merely a ministerial inquiry -- and everyone involved knows it.
