I agree. The King case exemplifies the kind of thinking that was cited in the NAACP article against Pickering.

Pickering simply questionned the notion that, anytime a person to whom civil rights laws or other anti-discrimination measures apply is injured, that injury is automatically a civil rights violation. The concept is ridiculous. Black people can be beaten up by white people for reasons other than racial discrimination or civil rights violation.

I don't know why this is a difficult concept for so many people...
