I don't know........is it possible they weren't known? The Swan case happened after his last hearing, I believe. All the other allegations would have been known during the last hearing. The ABA, a liberal organization of attorneys, whose advise is ALMOST ALWAYS followed, gave Pickering its highest rating. I believe it is correct to say that at no time in history has a judge having the ABA "Well Qualified" rating been denied an up or down vote. Until Pickering. Why this time?
