I paid the piper on eln today @ 2.9. watch it gap down tomorrow. anyway i'm thinking the market doesn't turn down again until bush addresses the un and with eln news @ the beginning of next week i got back in. if market breaks it will too.

rmbs should be fine as a buy and hold for a little while

RMBS:

This is a big win for RMBS.

In the ifx trial ifx was found to not infringe the rmbs patents and rmbs was also found to committ fraud in concealing its patents to the standard setting board. rmbs also had to pay ifx attorney fees.

This decision in just a quick look
1) throws out the fraud so that is dead.
2) over turns the lower court finding that ifx did not infringe and sends it back to lower court for trial
2) instruucts the lower court to reconsider the attorney fee decision.

Because the district court erred in its claim construction, this court vacates the grant of JMOL of noninfringement and remands for consideration under the revised claim construction. Additionally, because substantial evidence does not support the implicit jury finding that Rambus breached the relevant disclosure duty during its participation in the standards committee, this court reverses the denial of JMOL that let the fraud verdict stand. Based on the record evidence, the district court properly set aside the fraud verdict on the remaining technology. These holdings render the injunction moot and require this court to vacate and remand the attorney fees award for reconsideration in light of this opinion. The record evidence supports the district court’s grant of JMOL Accordingly, this court vacates-in-part, reverses-in-part, affirms-in-part, and remands.

a lot to read but no doubt a major positive for rmbs and a blow to ifx and mu and other dram makers.
