You are needlessly digging yourself a deeper hole.
Federal regulators never fined anyone for an "ethical disability." It's not in their lexicon, nor do they have the psychologists on staff to diagnose such a disability. And, were they to somehow officially conclude a person had "ethical disability", the disability itself wouldn't trigger the fine, an unethical action would.

If you can find a government link which shows people - anyone - ever getting fined for an "ethical disability", produce it. If not, agree that the allegation is stupid and disingenuous, and move on.
