Kirk, I need to clarify the details of my earlier post. It was not the hedge fund manager that was on TV, it was an attorney representing companies that were targeted by the negative research/publicity published by the hedge funds. In these cases, the companies felt that the information released by the hedge funds was untrue and causing damage to the stock value. An interesting point of the discussion was exactly who was affected, the shareholder or the company. During this interview the focus was on the fact that the hedge funds do not have to provide the full disclosure regarding their holdings.

You are correct that there is no difference between a stock being hyped as a long or a short holding as long as there is disclosure on both sides and the published research is accurate. This exact point was discussed and was viewed as fair game and, in fact, is good for the liquidity of the market.
