For years, a lot of these con-artist newsletter "gurus" have been taking advantage of a hole in SEC regulations big enough to drive a truck through. If you aren't a "registered" FA, apparently you can charge for advice (no matter how bad it is) without answering to any regulatory authority.

The question now becomes, is there anything that can be done about these guys...especially if they actively promoted penny-stock frauds (in Wolanchuk's case, VLNC being the most notorious example). The SEC has only pursued the most obvious "pump and dump" case (Tokyomex, Lebed, etc.) but I haven't seen many individual investors go after these guys in the courts.

At least...not yet. ;)
