It's not though. Even at birth the infant is at least a year away from conscious thought. I support the birth criterion because it is reasonable well defined, but there will be grey areas of miscarriage and late term abortions. The point is these are still early enough in the process that they don't approach the time of self awareness. It's not practical to try and legislate to that event, and that leaves birth as the event least likely to be misinterpreted.

Any time before or after is much more prone to argument and interpretation.
