I think the key is to look for the commons. Look for those areas where use or abuse by someone enevitably has a major effect on others. Take for example useing and fouling air or water resources. The harmful laws are those that only codify someone's or some group's personal prejustices. There are gradations of commons, and the laws should be no more restrictive than the degree of unavoidable common interaction inherent in the process being regulated.
