The choice is made by the mother. If she wishes to have the abortion she is like the suicide person. She is killing a piece of herself (half of what she created). If she does NOT choose to have an abortion, then the criminal has murdered that living part of her, which she created, and did not wish killed. He has taken the choice from her- we don't let people do that to other already born people. Further, when a suicide kills himself it isn't murder- a simple legal distinction. But, if you kill a person, even if they were going to commit suicide, it is murder. We can legally call things anything we want. So abortion, the legal taking of an unborn life is not murder, and the unlawful taking of an unborn life is. It's quite simple. There isn't any great mystery about the law being different. The law could treat both the same, but right now it doesn't.
