No, that is a poor prosecution.

It reminds me of a jury I was on a few years back. The defendant was charged with agrivated assault. It took 3 days to get down to the rather simple story that the guy was dumped by a girl, he went over to her house where some pleading and crying and yelling went on, but when she told him to go and he turned to leave, her roomate blocked the door and proceeded to give him a long winded piece of her mind. He pushed he aside and left. She claimed no more injury than falling on her bottom.

Was that a crime? The jury felt it was, but the next question is whether it was the crime that was charged. Agrivated assult required malice and injury. Neither was shown and the verdict returened was a unanimous innocent. After the trial we learned that the prosecutor was trying to pressure the guy on an unrelated burglery suspicion.

I think what is going on here is an attempt force a jury to return a verdict of innocent so that a bunch of hotheads can get riled up. At least in our state, the jury cannot find innocence for the crime charged, but guilt for a crime that the prosecutor has not formally charged. This will be trumped up as saying that because it was a fetus that no crime at all was committed when in fact it was the prosecutor filing the wrong charges.

So you would agree that the man charged with murder of the unborn child should not be charged for that murder.
He should not have been charged with that crime.
