Theres wiggle room : Iraq is in breach of 687 which came at the end of the 1st war, and that formed the background to 1441.

Since Resolution 1441 said that Iraq was already in material breach, it's up to Iraq to show that it has removed the material breach by complying with the terms of the resolution. Nobody but the Iraqis is claiming that they have done so; just that there is some "progress" and more time (lots more) should be allowed for them to come into compliance.
