Yes, I think they probably do on certain issues. But the litmus test is a presidential prerogative set forth by the Constitution -- specifically, the president has the power to appoint and Congress, absent a vote against a nominee, the power to confirm (Incidentally, Estrada is known to have forcefully prosecuted and won cases for the Clinton administration even though they were based on legal concepts contrary to conservative positions).

Absent something REALLY, REALLY wrong with a candidate, a president's nominee is to be approved. But we have this bizarre situation now where well-qualified candidates are being rejected without even receiving a vote on the Senate floor. It really is sort of unseemly.
