Sorry but Wolly can't wiggle out of this so easily. The "next generation cell phone" tout was made 4 years ago. Several "next generations" of Motorola cell phones have come and gone in those 4 years. Wolly didn't say he THOUGHT it POSSIBLE that in the future, some version of a Motorola cell phone MIGHT use a Valence battery. He said, "Motorola's next generation cell phone? They haven't said whose battery they are going to use. We KNOW whose battery they're going to use - all kinds of great things are coming for Valence."

Even in the unlikely event that Motorola does use a Valence battery in a cell phone at some point in the future, it would not change the fact that that comment (1) strongly suggested Wolly was in possession of material non-public information, and (2) has proven to be absolutely false.

It occured to me that the SEC went after that Lebed kid for stock touts that were far less specific and far less definitive than this obvious b.s., in my opinion. I wonder if Wollie would look good in stripes?
