Sun- Thanks for your response. I was actually describing a very good friend of mine who I would not classify as a professional trader as the number of executions per month on his account can be counted on one hand, i.e. he's not a trader at all. Secondly, he has all the required licensing but has no compliance issues as he only manages his own account. I was trying to make a point...and that is the amount of one's account in some cases is greater than some small hedge funds (institutional) OTOH, not managing other's money and not being subjected to typical compliance issues maybe construed as retail.
