In fact, you do not know my position, nor understand what you do know. Law is different from the aphorisms of the famous, and it is the judge's job to interpret the law. Interpretation also means that one may have to apply to novel circumstances the principles inherent in the actual statute, and therefore requires abstraction or analogy to handle that which is not clearly contemplated in the original legislation. Additionally, "original intent" is not really the issue, as much as making a reasonable deduction from the language of the statute, and other supporting material as makes sense of the statute and its application. Thus, the idea is that the jurist should avoid, as much as possible, usurping the function of the legislature, and to that end that he tether his ruling to a reasonable extrapolation from the language of the statute.........
