I asked him to tell me 'what was unconstitutional in a filibuster' and he replied that it 'violates separation of powers'.

Apparently he fails to realize that confirmation is a power reserved for the Senate... and that the organization of the Senate (it's rules, and how it operates) has been held by the Courts to be solely a matter for the Senate.

To interfere with that would be 'unconstitutional'.
