Realistically, Taleban were given adequate notification to disengage from AQ, and to turn over AQ members. They chose not to. US said "war on terrorism" not "war on a state". Inference is "war on AQ".

So, Mr. Roth recognizes them as soldiers of the Afghan army, while Afghanistan itself evidently does not. Perhaps you can show me the document where the government of Afghanistan authorizes Mr. Roth to do so on their behalf.

The UN recognized government of Afghanistan, and thus High Contracting Party, was the Rabbani government in exile, not the Taliban.

As someone has already posted to you, Jacob, the Taliban was not the recognized Government of Afghanistan. The only state that was dealing with them as Pakistan, and they were not recognized by the UN.

This debate you are having with yourself was done to death about six months ago here by Zonder, when she was posting here. The prisoners at Gitmo are criminals, not POWs.
