Even if we extended POW status to members of the Taliban, that wouldn't apply to members of Al Qaeda, who are not Afghani, but, for the most part, Arabs. Saudis, Yemenis, Egyptians, not Afghanis, not Taliban.

So give me an argument that explains how Yemeni and Egyptian members of Al Qaeda who got their marching orders from bin Laden are nevertheless regulars in the Afghan army, even though they never wore the uniform of the Afghan army or drew pay from the Afghan government.

And after that you can explain how pirates are actually part of the Navy.

Thus, whether a government is recognized or not, members of its armed forces are entitled to POW status without the need to meet the four-part test.

Is any group of persons that declares themselves a government, actually a government? Or are a band of bandits just a band of bandits, regardless of how many people they manage to bully?

If me and my fellow banditos manage to take over the Taco Cabana across the street, and declare that the whole shopping plaza is hereafter to be referred to as the Cabana Free State, with myself as el Presidente, does HPD have to afford me Geneva Convention rights, just because I say so?
