From whence derives this "policy ban"? Executive order?

Does it define "torture"?

Does handing over a prisoner to a country that has a different policy until the information sought is obtained, and then accepting him back violate US policy?

If the policy is violated, are there sanctions, and if so, what are they, and who administers them?
