ESS expands suit against Taiwan's MediaTek

FREMONT, Calif. -- Consumer-chip maker ESS Technology Inc. here today (March 12, 2003) announced it has expanded its suit against Taiwan rival MediaTek Inc. over alleged copyright infringement.

Last year, ESS filed a lawsuit alleging Taiwanese optical chip designer MediaTek infinged copyright of the DVD firmware used within ESS' Swan and Vibratto chips (see Sept. 30, 2002 story ).

ESS' new motion, filed in the United States District Court for the Northern District of California, alleges that MediaTek intentionally and unlawfully copied ESS's DVD firmware and user interface.

The motion requests that the court issue a preliminary injunction to immediately stop MediaTek's products and DVD players containing those products from being imported into the United States and recall all infringing products from distributors, retailers and end users. Alternatively, the motion asks the court to grant an expedited trial which would make the injunction permanent should ESS prevail.
