Actually, the question is whether there is any law prohibiting a state or local government from doing so. If a state legislature duly enacts a law prohibiting flying the flag, I would say they can't do it; otherwise, they can.

The question of whether such a law SHOULD be passed in another issue. In general, my view is that laws shouldn't be passed unless there are good reasons for them.

For example, my idiot state representative's kid struck out in a baseball game last year. So this nitwit introduces a bill requiring little league umpires to have eye exams on a regular basis. While we could all agree that it is reasonable for these guys to have eye exams, I'm not sure a law is called for.

This is an issue for the state itself to resolve. If more people want to keep it up than take it down, let them. If it hurts their image or affects tourism, so be it. I see some in the state are trying to get tourists not to come visit until the flag is taken down. That's cool, maybe it'll tell the stubborn that the Confederate Flag isn't exactly good PR. If Southern pride is more important than that, then let them have their pride.

As for being "offended," maybe you ought to figure in those people who would be offended if the state took down the Confederate Flag. Tell me why their opinions don't matter. I'll bet you the reason has to do with the Thought Police thinking they're more "sophisticated" than anyone else.
