we had not declared War Congress never did declare war in this instance. In fact, I think the last time Congress actually followed the Constitution and declared war was in 1941 against NAZI Germany and Imperialist Japan. Presidents have always fiddled with their power to declare war. Congress tried to reign Presidents in after Viet Nam with the War Powers Act. But, Reagan/Bush obliterated that, espeically with the first Gulf War. Clinton certainly abused his war powers a number of times. Now Bush 43 is engaging in a full scale war without a Congresional declaration of war. Might as well tear up the Constituion, because the President and Congress aren't following it anymore.
