The primary difference between a POW and Al Qaeda is that under international law, war is justifiable homicide, but terrorism is not. It is a crime. Criminals are not subject to the Geneva Convention.

Take a look at how we are treating the Iraqis POWs, if you need further exposition. Some of the Iraqis we capture will be subject to military tribunals as war criminals. That should further help you to understand the distinction.
