You have a reading problem? The "shoot on sight" was BEFORE the declaration of war. By many months. And, by your logic, knowing a war is coming is no excuse for military action without a declaration of war. Yes?

Oh, and since you are so critical of Bush, what of all those other Presidents that took military action without a declaration of war? Are you ready to level the same charges against Jefferson? FDR? JFK? LBJ? Carter? Clinton?

And, Jefferson being the guy who actually wrote the Constitution (Secretary of the Constitutional Convention), his action can be taken to indicate that the Framers understood that there might be circumstances when military action without a declaration might be necessary.

Either that or the guy who wrote that document was among the first to violate it.
