Monbiot can make as many accusations as he wishes, but for now the US has declared them unlawful combatants.

This declaration is by itself a violation of Geneva. The status must be determined by a competant tribunal, and the U.S. denied the prisoners that. Furthermore, while the status of Al Qaeda prisoners might perhaps be debated, the status of Taliban prisoners is not.

Both of those points were in the article. I'm not sure what you hope to accomplish by responding to Monbiot with arguments that he has already refuted?
