I wrote about this last year and hewyone and others said I was wrong. Tom is by far one of the worst abusers of option grants.

I have been pointing out for a couple of years that Tom Siebel is a stock options abuser. Unfortunately most stock options abuse is perfectly legal. I think my point to you a year or two ago was why would a company abuse stock options illegally when most companies have been able to do so legally without investors holding them accountable for it? We still have to wait for the results of the trial to find out whether Sebl did anything illegal. Sebl could be innocent of illegal stock option abuse, that is issuing options below market value and not recognizing an an expense, but still be guilty of legal stock option abuse, that is issuing options at market value (which currently doesn't require recognition of an expense) at a grant rate that leaves nothing for outside shareholders.

More on Tom's Option Problems.

This is not an isolated incident. There are many other internal problems at SEBL that are becoming more evident. For example, there sales channel for dedicated client license is in conflict with their OnDemand CRM. As a result, sales managers and sales executives are leaving in droves. This is a direct result of Tom's management style. I have spoken to more than one AE at Siebel who tells me that Tom does pay according to the incentive plan that is presented to the AE's. He has failed to pay on several big license sales deals and this makes for a very unmotivated sales force. As a result, anyone with talent is leaving.

In addition, their professional services group is in complete disarray. They have promoted an offshore model in order to compete with low cost structure services firms, and as a result have destroyed their own services group without as much as one customer to reference for their off shore model.

As an added bonus for those following the illegal stock option grants the SEC has made a formal inquiry into SEBL's stock option grant practices.
