Thanks for the link to the International Law Commission. I've only just skimmed it so it's not yet clear to me what exactly the original purpose of it was, or who ratified it or exactly what weight of law is imposed upon member countries. I will be reading into it further.

However, on the assumption the USA is a signatory and is bound by the rules I did notice that Article 7 reads, "Every State has the duty to ensure that conditions prevailing in its territory do not menace international peace and order."

It seems to me it's not overly far-fetched to suppose that this particular article could be used to justify the US's intervention in Iraq if indeed they were manufacturing weapons of mass destruction.

This particular conversation began when llmarinen claimed that the USA was waging an illegal war and I wondered how he came to that conclusion. It would appear to me that at a minimum the issue is highly debatable and it would be unfair to draw any conclusions about it's legality at this moment in time.
