The case is:

1. Take the arguments made by U.S. prosecutors at the Nurenburg trials.
2. Apply them to the current doctrine and actions of the U.S.
3. Make the following connections:
Preventive war = war of aggression = war crime

The above is the consensus opinion of most of the world's governments, and most of the world's peoples. And, yes, this is precisely why we will not join the ICC: We insist on a double standard. We refuse to allow the standards we apply to our defeated enemies, to be applied to ourselves. Our overwhelming military victory in Iraq will not change the verdict of history. There will never be peace or stability in the world, until all nations give up preventive wars as a tool to achieve national goals.
