Yes, I reluctantly agree with that. It sounds a lot like marriage laws in the US. There are "default" standard laws on the books for divorces, i.e., the wife usually gets the kids, the husband has to pay child support, etc.

I'm not sure how strictly pre-nuptual agreements are enforced, but I'd be interested in finding out.

Anyway, my main point was not really the ability to customize the contract, but rather the ability to circumvent the tyrannous juries with mutually agreed upon private arbitration.
