As foreign terrorists they have a status apart from soldiers and civilians. Eventually, the US will prosecute, court martial or deport them. As you may know, some have already been released back to their countries of origin.

I have heard some international groups have already been at Gitmo to review the treatment being given to prisoners. There have been no reports of torture.

If CIA agents are operating as terrorists in foreign countries and are caught I would hope they are accorded treatment no less than the el-Qaeda prisoners at Gitmo. However, I don't believe they are operating as terrorists.
