Interesting idea.

I don't think the Bush folk are likely to do it, however. They don't want the public to know just how radically conservative these judges are. Witness the unwillingness of many of them to answer straightforward questions, much as Clarence Thomas failed to do. Going public with the strategy this writer advocates would throw this entire thing into broad relief. The Reps would be very susceptible to the "stacking the court argument."

I think Karl Rove is too smart for this one.
