Ashcroft asked for that right but the congress did not give it to him. However, it seems life is not so easy for non-citizens (remember it takes many many years for a resident to become an American citizen):

[Patriot Act] Permits non-citizens to be jailed based on mere suspicion and to not be allowed readmission to the US for engaging in free speech. Suspects may be detained indefinitely without charges or court review even if they have never been convicted of a crime.

There has to be a balance between liberty and security. Finding that balance has always been tricky, always will be.

Agreed. Tricky. But very VERY important. If you wish to live in a democracy respectful to human rights, that is...

On this note, I remember some scenes from the film "The Siege" with Bruce Willis. They were not pretty.
