Then he isn't familiar with the issue. Like I said, it's beat to death in every Ethics class in America. Definately all the Philosophy of Law courses.

The right to privacy is not absolute. We recognize that there are classes of actions that are prohibited, even if practiced in private. The issue with the homosexual couple was that they were arrested under state sodomy laws after being caught engaging in sex. They want the law ruled unconstitutional on privacy grounds. Not likely, as I see it, from what I know of the case law. Santorum was paraphrasing the verbage of the issue used to bore college students all over the country. Incest is illegal regardless of whether it is behind closed doors or not, as is child pornography, child abuse, etc. Likewise, it is argued, just because you are breaking the sodomy law in the privacy of your own home doesn't mean you're not really breaking the law.

You can raise the issue of what are the limits of investigation by law enforcement - another "bore the college student 101" issue. You can also argue whether or not sodomy and the homosexual sex act poses a real harm - which is addressed by many, and which Santorum paraphrased, as "yes, because it undermines the foundations of the family." But what Santorum's detractors are arguing is that he is a fag hating bigot. Which has absolutely nothing to do with what he said, and everything to do with politics.
