Irwin is going to jail. If Bernie or other mgrs of the former GSTRF consortium are liable for negligence, then senior mgt of QCOM is just as culpable for entering into contracts that were not enforceable and for their creative accounting related to GSTRF. But, since all are simply guilty of poor business (i.e. a lose-lose situation), ultimately, we as shareholders wind up holding the bag (since we may have been foolish enough to invest) or, if you had the foresight to sell, you did okay. imho.
