The cry of "illegal shorting" is a staple of the penny-stock scam playbook. Ninety-nine times out of a hundred there's nothing to the charge at all (the giveaway is that the charge is almost never directed at anyone specific), and, often as not, particularly in the world of the sub-penny stocks, there isn't any short interest at all, legal or otherwise.

Just another ploy to get the sucker to think he's getting a bargain when he's really about to get reamed.
