The issue is Barbary Coast lying about what the company said:

The firm, Barbary Coast Capital, issued a statement to its limited partners stating that Chattem "confessed that its growth by acquisition strategy is not working."


Regardless of the merits of a CHTT short position (which never concerned me, I don't follow the stock), the issue is clear. The hedge fund claimed the company admitted the strategy wasn't working and the company denied making any such statement.

The retraction from Barbary Coast subsequently makes the likely facts pretty clear. They stepped over the line by inventing material. I like to keep track of people who lie on the record and get caught.
