Srini - Is it possible that if so, could they be waiting for WCDMA to gain critical mass before throwing a monkey wrench in the works such that the disruptive threat (and the value of their claim) is maximized?

I forgotten the legal term for this, but no. If you know that your patent is being violated and you choose not to notify the putative user for a certain amount of time then the courts tend to rule against future enforcement.
